Mark Temple acted for the trustee of the B Trust in applications for directions to the Royal Court following UK divorce proceedings concerning two beneficiaries. This case involved consideration for the first time of the provisions of Article 9 of the Trusts (Jersey) Law 1984 (as inserted by the Trusts (Jersey) (Amendment No. 4) Law 2006) concerning conflicts of laws and the application of foreign law judgments to Jersey trusts on the very day the new provisions came into force.Other offshore jurisdictions, such as Cayman and the British Virgin Islands, have enacted similar provisions and, as far as we are aware, the judgment is the first of its type worldwide.
