Competition Law



 

The Jersey Competition Law team at Mourant du Feu & Jeune comprises five lawyers who are experienced in all aspects of the Competition (Jersey) Law 2005. 

Since the Law came into full force on 1 November 2005, it has had a profound impact on the conduct and timing of mergers and acquisitions in Jersey. Under the merger control provisions, failure to obtain the prior approval of the Jersey Competition Regulatory Authority (the JCRA) to a notifiable transaction may have serious repercussions for the parties to the transaction. The sanctions against restrictive practices, cartels and abuses of a dominant position have also had a direct impact on day-to-day business in Jersey. 

We have been involved in many of the applications which have been made to the JCRA for approval under the Law’s merger control provisions and have regularly advised on a full range of Competition Law matters such as:

  • advising both multi-national and local clients on the impact of the Law on their arrangements with customers and third parties;
  • seeking exemptions under the Law for potentially anti-competitive arrangements;
  • advising clients on the abuse of dominance provisions and their implications for the conduct of business;
  • advising a trade association which was being challenged by the JCRA for anti-competitive behaviour;
  • providing clients with tailored training on the Law; and
  • drafting Competition Law compliance manuals.
The team has also been appointed by a major financial services institution in Jersey to advise it in the event of a "dawn raid" by the JCRA.
