Much of the work the team undertakes, including such as tax and regulatory investigations, reviews and audits, is highly confidential.
Examples of cases in the public domain are:
- AG -v- Caversham & Or: Prosecuting this ground-breaking case involving breaches of Jersey's AML policies and procedures. Jersey's Royal Court and Court of Appeal each ruled on the meaning of the statutory requirement to "maintain" effective AML procedures.
- Cable & Wireless v The Information and Communications Authority: Acted for Cable & Wireless before the Cayman telecoms regulator and in subsequent judicial review proceedings in the Grand Court and Court of Appeal in a series of disputes involving complex issues relating to the mobile termination rate and telecoms competition law.
- Jersey Financial Services Commission ("JFSC") : Belgravia Group of Companies: Acted for the JFSC on all aspects arising further to the collapse in Jersey of fund manager Belgravia, issues arising concerning the funds managed and the winding up of various entities.
- Golden Accumulator v The Cayman Islands Monetary Authority (CIMA): Acted for CIMA in judicial review proceedings relating to CIMA's directive for the production of information to assist an overseas regulatory authority.
- R2R Trusts: Acting for the incoming trustee in relation to various trusts/funds where the JFSC petitioned for their "just & equitable" winding up. Advising on the full range of issues arising.
- A P Black: Acting in the JFSC's application for investor compensation against a Jersey functionary of an alleged collective investment fund.
- Kraft/Cadbury: Helen Ruelle and Matt Shaxson acted for Kraft Foods Inc in relation to its application to the JCRA for approval of its takeover of Cadbury plc. The timing of the application to the JCRA and global takeover meant that the application process was innovative - Helen and Matt worked with Kraft and the JCRA in providing certain commitments to the JCRA in relation to the integration of the Jersey operations of Kraft and Cadbury pending the JCRA's decision. It is believed that this is the first time the JCRA has adopted such an approach in a global transaction.
