Mourant partners Justine Lau, Claire Fulton and Christopher Harlowe were joined by Jacqueline Chan, Partner at Milbank LLP and Patrick Cowley, Head of Restructuring Services at KPMG for a panel discussion on Thursday 10 December.
The panel explored a liquidator's ability to review and potentially challenge transactions entered into by a debtor in the twilight zone of insolvency, and avoiding or hedging against any such challenge is a perennial concern amongst institutional creditors. This whistle-stop tour through the law looked at practical application to financing transactions and an insolvency appointment taker's perspectives on challenging such transactions.
