We are pleased to celebrate the publication of a new book by a member of our International Trusts and Private Client team.
Mourant Consultant Tony Pursall, alongside leading Chancery barrister James Kessler KC, has authored the second edition of Drafting Cayman Islands Trusts, published by Bloomsbury on 12 March 2026.
Written in a straightforward, modern style and providing a set of trust precedents, this book is a value-adding reference work on key areas of Cayman Islands trust law for private client practitioners.
It contains a detailed discussion of administrative provisions, some of which are not generally dealt with in conventional textbooks on English trust law, and provides answers (with appropriate reasons and authority, where available) to a number of important questions facing practitioners – including whether forfeiture clauses are valid, if automatic flee clauses work, and whether STAR trusts would be recognised in other jurisdictions.
The second edition reflects important new case law in the Cayman Islands, England and Wales and other leading trust jurisdictions, as well as legislative changes and changes to drafting practice, alongside fully updated precedents. There are new precedents dealing with appointments to beneficiaries, the resettlement of assets on new trusts and an extensively revised precedent for a STAR trust to be used for anti-Bartlett planning. The commentary has also been expanded, including a new section discussing powerholders’ duties in more detail, with suggested precedents.
“This new edition of Drafting Cayman Islands Trusts is a testament to Tony’s deep expertise in Cayman Islands trust law. The enhancements and updated precedents will be invaluable to practitioners navigating an increasingly complex landscape, and we’re proud to see Tony’s work continue to support the highest standards of practice across our industry.”
Tony is an experienced member of the firm with over three decades of experience advising trustees, beneficiaries, protectors, banks and high-net-worth individuals on a wide range of trust and private client matters.
He co-authored the first edition of Drafting Cayman Islands Trusts as well as Drafting British Virgin Islands Trusts and Guernsey Trust Law. Tony is also the Cayman Islands country correspondent for Trusts & Trustees, the leading international journal for trust law and practice.
